It needs to be in the 2.6.32.y "longterm" tree.

You can request that by mailing stable@xxxxxxxxxx and the original patch
author(s) and suggesting that that changeset is backported to 2.6.32.x.

The fact that it has gone into 2.6.38.y suggests it should be a
reasonably easy ack to obtain.
